Terms of Use and Safety Acknowledgement

Effective May 23, 2026. Use of this service means you accept these terms and agree to keep each recovery record complete and accurate.

Scope and acceptance

These Terms of Use and Safety Acknowledgement apply to the Ditch Hitch Safety application and admin portal. By creating an account, signing in, starting a recovery, completing a checklist, capturing a signature, reviewing records, or using the service in any way, you agree to these terms.

If you do not agree, do not use the app or admin portal. If you are using the service for your employer or organization, you confirm that you are authorized to use it on that organization's behalf.

Authorized account use

The service is intended for company-authorized operators, supervisors, safety personnel, company admins, and super admins involved in Ditch Hitch vehicle recovery workflows.

  • Use only your own account and keep your login credentials secure.
  • Do not share accounts, impersonate another user, or submit records for a recovery you did not participate in.
  • Do not access, modify, export, delete, or interfere with records outside your company, role, or authorization.
  • Company administrators may review records associated with company users, recoveries, training activity, notifications, and audit history.

Safety acknowledgement

Vehicle recovery is hazardous. Shock loading, stored kinetic energy, improper attachment points, equipment failure, poor communication, traffic, terrain, weather, and bystanders can lead to property damage, serious injury, or death. The service helps document a safety workflow; it does not make an unsafe recovery safe.

  • Complete the Pre-Job Checklist before the recovery attempt.
  • Use the Ditch Hitch system only as trained and according to organization procedures, site rules, product instructions, and applicable laws.
  • Use appropriate recovery straps, safety equipment, communication methods, and traffic or bystander controls.
  • Do not use chains, hooks, trailer balls, bumper-mounted receivers, tow hooks, tail chains, or other unsafe attachment points for shock-load vehicle recovery.
  • If a recovery cannot be completed safely, stop the operation and call for appropriate recovery assistance.

Training, checklist, and procedures

Training material, checklist questions, recovery documentation screens, notifications, and safety reminders are support tools. They do not replace competent supervision, professional judgment, employer procedures, site-specific hazard assessment, or formal safety training.

  • Operators must understand the recovery procedure before proceeding.
  • Both parties must review checklist answers together before signing.
  • False, rushed, incomplete, or misleading answers may create unsafe work and unreliable legal records.
  • You are responsible for stopping work if conditions, equipment, people, or environment make the recovery unsafe.

Electronic signatures and legal records

Completed recovery records may include checklist answers, printed names, electronic signatures, photos, GPS coordinates, timestamps, operator details, sync status, and audit logs. These records may be used for safety, compliance, training, incident review, reporting, and liability defense.

  • A printed name and electronic signature confirm that submitted information is accurate to the best of the signer's knowledge at the time of signing.
  • After signature, a recovery record is treated as locked and cannot be edited by the operator.
  • Company administrators may archive records where permitted, but archived records may remain stored for legal, safety, audit, and compliance purposes.
  • The service may keep a history of actions taken on a record, including creation, completion, signature, sync, archive, and administrative events.

Photos, GPS, and device permissions

The mobile app may request access to camera, photo library, location, notifications, and local device storage. Some functions may not work if permissions are denied.

  • GPS coordinates are used to document where a recovery took place.
  • Photos support the recovery record and may be visible to authorized company users.
  • Notification permissions are used for recovery alerts, training reminders, and pending sync reminders.
  • Offline records may be stored on the device and uploaded automatically when connectivity returns.

Acceptable use and security

  • Do not attempt to bypass authentication, permissions, company isolation, audit logging, or record locking.
  • Do not upload malicious files, false records, irrelevant photos, or content that violates company policy or law.
  • Do not interfere with sync, notifications, storage, database rules, or app security.
  • Report suspected unauthorized access, lost devices, incorrect company assignment, or record errors to your company administrator promptly.

Service limits and availability

The service is designed to support offline work, but no system can guarantee uninterrupted operation. Sync, notifications, GPS, photos, storage, and downloads may depend on device settings, operating system permissions, connectivity, third-party services, and company configuration.

No emergency service

The service is not an emergency response service. If there is immediate danger, injury, fire, traffic risk, environmental hazard, or another emergency, stop work and contact the appropriate emergency, supervisor, or recovery assistance channels according to site procedure.

Updates to these terms

These terms may be updated as the app, safety workflow, company requirements, or legal requirements change. Continued use of the service after an update means you accept the updated terms.
